Alabama alimony eligibility
Alabama Code §30-2-57 requires express findings before rehabilitative or periodic alimony is awarded.
Section 30-2-57 requires findings that the requesting spouse lacks a sufficient separate estate to preserve, to the extent possible, the economic status quo of the marriage, that the other spouse can provide support without undue economic hardship, and that an award is equitable. [1]
The statute gives priority to rehabilitative alimony unless the court expressly finds rehabilitation is not feasible, a good-faith rehabilitation effort fails, or rehabilitation only partly restores the spouse’s ability to preserve the marital economic status quo. [1]
Alabama alimony duration
Alabama sets different duration rules for rehabilitative and periodic alimony.
Rehabilitative alimony is generally limited to five years absent extraordinary circumstances. Periodic alimony is generally limited to no longer than the length of the marriage when the marriage was shorter than 20 years, unless the court finds an equitable deviation is required. For a marriage of 20 years or longer, §30-2-57 does not impose a marriage-length time limit on eligibility for periodic alimony. [1]

Alabama alimony termination
Periodic alimony can terminate after remarriage or qualifying cohabitation.
Section 30-2-55 requires modification to terminate periodic alimony upon petition and proof that the recipient remarried or is cohabiting as defined by the statute. Rehabilitative and periodic alimony also terminate upon the death of either spouse under §30-2-57. [2]
