Alaska spousal support law

Alaska courts decide spousal support from the spouses’ circumstances, not a statewide percentage formula.

Alaska Statute §25.24.160(a)(2) allows maintenance for a limited or indefinite period when it is just and necessary. The court considers marriage length and marital standard of living, age and health, earning capacity, education and work history, financial condition and health-insurance costs, unreasonable depletion of marital assets, property division, and other relevant circumstances. [2]

The Alaska Court System describes spousal support as uncommon compared with property division and says the court decides whether support is needed and fair from the facts of the case. [1]

Alaska support types

Alaska court guidance distinguishes rehabilitation support from reorientation support.

Rehabilitation support is tied to school or job training that can improve the recipient’s ability to work. The Alaska Court System says this support usually lasts for the reasonable time needed to complete the program and is usually up to four years. [1]

Reorientation support helps a spouse adjust to a lower post-divorce standard of living when property division does not meet reasonable needs. The court’s self-help guidance says it is usually short-term, generally a year or less. [1]

Those are court-guidance descriptions, not statutory maximums. The calculator therefore never labels four years or one year as a guaranteed legal limit.
