Arkansas alimony law

Arkansas courts focus first on financial need and the other spouse’s ability to pay.

Arkansas Code §9-12-312 authorizes an alimony order that is reasonable from the circumstances of the parties and the nature of the case. Arkansas appellate decisions identify the financial need of one spouse and the other spouse’s ability to pay as the primary considerations. [1] [2]

Secondary considerations include each party’s financial circumstances, income and anticipated income, resources and assets, earning capacity, marital standard of living, health and medical needs, marriage duration, and other case-specific circumstances. [2]

Arkansas rehabilitative alimony

Arkansas law allows rehabilitative alimony but does not assign a statewide percentage or fixed term.

Section 9-12-312 allows rehabilitative alimony in fixed installments for a specified period. When rehabilitative alimony is requested, the payor may ask for, or the court may require, a rehabilitation plan so the court can evaluate whether the plan is feasible and determine the amount and duration. [1]

The statute does not turn marriage length or income difference into a statewide award formula. That is why this page compares a payment chosen by the visitor instead of producing a predicted Arkansas court award.
