Indiana spousal maintenance eligibility
Indiana Code §31-15-7-2 limits court-ordered maintenance to three statutory categories.
Indiana Code §31-15-7-2 allows incapacity maintenance when a spouse’s physical or mental incapacity materially affects that spouse’s ability to support himself or herself. It also allows caregiver maintenance when a spouse lacks sufficient property for the spouse’s needs and must forgo employment to care for a child whose incapacity requires that care. [2]
The same statute allows rehabilitative maintenance after the court considers education, interrupted education or employment caused by homemaking or child-care responsibilities, earning capacity, and the time and expense needed to obtain education or training for appropriate employment. [2]
Indiana maintenance duration
Indiana rehabilitative maintenance may not exceed three years from the final divorce decree.
For rehabilitative maintenance, Indiana Code §31-15-7-2 sets a maximum of three years from the date of the final decree. Incapacity maintenance may continue during the period of incapacity, subject to further court order. For caregiver maintenance, the court may set the amount and period it considers appropriate if the statutory findings are made. [2]
