Kansas law requires maintenance to be fair, just, and equitable under the circumstances.
Kansas Statutes §23-2902 allows either spouse to receive maintenance in an amount the court finds fair, just, and equitable. The award may be a lump sum, periodic payments, a percentage of earnings, or another basis. [1]
The statute does not publish one statewide percentage that converts two incomes into an award. Kansas appellate decisions describe courts as having broad discretion and identify circumstances such as age, earning capacity, marriage length, property, needs, family obligations, and the parties’ overall financial situation. Kansas maintenance duration
A Kansas maintenance period cannot exceed 121 months, but that is not always the end of the analysis.
Kansas Statutes §23-2904 says a court may not award maintenance for a period longer than 121 months. If the original decree reserves the court’s power to hear later reinstatement motions and the recipient files before the current maintenance period expires, the court may reinstate maintenance. Does Kansas use an alimony formula?
No single statewide dollar formula appears in §23-2902. Kansas law uses the term maintenance, and §23-2901 states that “alimony” and “maintenance” are synonymous for interpretation.
Is Kansas maintenance limited to 121 months?
A single maintenance period cannot exceed 121 months under §23-2904. The statute can permit later reinstatement periods when the original decree reserved that power and the procedural requirements are met.
Does the 121-month rule mean I will receive maintenance for 10 years and 1 month?
No. It is a maximum period rule, not a predicted duration. A court can order a shorter period or no maintenance at all.
