Kentucky maintenance eligibility

Kentucky courts must make threshold findings before awarding maintenance.

KRS 403.200 allows maintenance only if the spouse seeking it lacks sufficient property, including marital property awarded to that spouse, to provide for reasonable needs and is unable to support himself or herself through appropriate employment, or is caring for a child whose circumstances make outside employment inappropriate. Kentucky maintenance amount and duration

Kentucky law uses statutory factors instead of a statewide maintenance formula.

If the threshold findings are met, KRS 403.200 directs the court to set an amount and period it considers just after reviewing the requesting spouse’s financial resources, time needed for education or training, the marital standard of living, marriage length, age and physical and emotional condition, and the other spouse’s ability to meet both households’ needs. [1]

The statute does not assign a percentage of income or a fixed duration by marriage length. This site therefore does not convert the income difference or marriage length into an estimated Kentucky court award.
