Maine general support

Maine law uses rebuttable presumptions based on marriage length for general support.

Title 19-A §951-A recognizes general, transitional, reimbursement, nominal, and interim spousal support. General support helps a spouse with substantially less income potential maintain a reasonable post-divorce standard of living.

For general support, Maine creates a rebuttable presumption against an award when the marriage was shorter than 10 years. For marriages of at least 10 years but not more than 20 years, Maine creates a rebuttable presumption against a term longer than half the marriage. A court may rebut either presumption if applying it would be inequitable or unjust.

Maine does not provide one statewide dollar formula for spousal support.

The court considers marriage length, ability to pay, age, employment and income history and potential, education, health, homemaker contributions, marital standard of living, self-support prospects, property income, child support, and other appropriate factors.
