Maryland alimony amount

Maryland courts decide alimony amount and duration from statutory factors.

Maryland Family Law §11-106 requires the court to determine the amount and period of alimony after considering factors needed for a fair and equitable award. Those factors include each spouse’s ability to be self-supporting, time needed for education or training, the marital standard of living, marriage length, contributions to the family, age and health, financial needs and resources, obligations, retirement benefits, and the paying spouse’s ability to meet both spouses’ needs. The statute does not provide a statewide percentage formula. That is why this page asks you to enter a payment instead of generating a Maryland award amount.

Types of Maryland alimony

Maryland recognizes temporary, rehabilitative, and indefinite alimony.

Maryland Courts describes pendente lite alimony as temporary support while the divorce case is pending, rehabilitative alimony as support for a limited time or purpose, and indefinite alimony as support with no set end date. [2]

Section 11-106 allows indefinite alimony only when the court makes one of two findings: the spouse seeking alimony cannot reasonably be expected to make substantial progress toward becoming self-supporting because of age, illness, infirmity, or disability; or the spouses’ living standards would remain unconscionably different even after reasonable progress toward self-support. [1]

When Maryland alimony must be requested

Maryland Courts says alimony must be requested before the divorce is final.

Maryland Courts states that alimony can only be ordered before the final divorce decree is entered and cannot first be requested after the divorce is final. [2] This calculator does not determine whether a particular filing preserves an alimony claim.
