Mississippi alimony authority

Mississippi chancery courts decide alimony based on what is equitable and just in the circumstances.

Mississippi Code §93-5-23 gives the chancery court discretion to make orders for either spouse's maintenance and alimony after divorce based on the circumstances of the parties and the nature of the case. [1]

The statute does not contain a statewide percentage formula for the amount or a marriage-length table for duration.

The Armstrong factors

Mississippi courts use the Armstrong factors when deciding whether to award alimony and what form, amount, and duration are appropriate.

Mississippi appellate courts continue to require chancery judges, called chancellors, to consider the factors from Armstrong v. Armstrong. A 2025 Court of Appeals decision again listed and applied those factors, and a 2024 decision applied them while reviewing periodic and rehabilitative alimony. [2][3]

The Armstrong factors include the spouses' income and expenses, health and earning capacity, needs, obligations and assets, marriage length, minor children in the home, age, marital standard of living, tax consequences, fault or misconduct, wasteful dissipation of assets, and other circumstances the court considers just and equitable.
