Nebraska alimony amount
Nebraska courts decide reasonable alimony from statutory criteria and the facts of the case.
Nebraska Revised Statute §42-365 directs courts to consider the circumstances of the parties, duration of the marriage, each party's contributions to the marriage including care and education of children, interruptions of careers or education, and the supported party's ability to work without interfering with the interests of minor children in that party's custody. [1]
The statute does not assign percentages to those criteria or provide a statewide dollar formula. This calculator therefore uses a visitor-selected payment for budget arithmetic instead of presenting a predicted award.
Nebraska court guidance
Fairness and reasonableness control, and alimony is not supposed to equalize income or punish a spouse.
Official annotations published with §42-365 describe fairness and reasonableness as the “polestar” of alimony analysis. They also say alimony should not be used to equalize incomes or punish a party, and identify income, earning capacity, and the general equities of the situation as relevant considerations. [1]
The annotations also recognize alimony as a possible bridge during a reasonable period of unemployment or training. That does not create a fixed statewide duration schedule.
Nebraska modification and termination
Section 42-365 contains separate rules for changing and ending alimony.
An alimony order may be modified or revoked for good cause, but amounts accrued before a modification complaint is filed cannot be modified or revoked. Unless the parties agree otherwise in writing or the court orders otherwise, alimony terminates on the death of either party or remarriage of the recipient. [1]
