Ohio courts decide whether spousal support is appropriate and reasonable after considering the factors in Ohio Revised Code §3105.18.

Ohio Revised Code §3105.18 allows a court to award reasonable spousal support in a divorce or legal separation. The court must consider the statutory factors when deciding whether support is appropriate and reasonable and when setting the nature, amount, terms of payment, and duration. [1]

The factors include income, relative earning ability, age and health, retirement benefits, marriage length, child-care responsibilities, marital standard of living, education, assets and liabilities, contributions to the other spouse’s earning ability, education or training needs, tax consequences, and lost income-producing capacity caused by marital responsibilities. Ohio law treats marriage length as one factor, not as a statewide duration formula.

Section 3105.18 requires the court to consider the duration of the marriage, but it does not convert marriage length into a statewide number of support months or years. [1]
