Oregon spousal support amount

Oregon courts can order transitional, compensatory, or maintenance support.

ORS 107.105 directs an Oregon court to designate one or more categories of spousal support and make findings on the relevant factors. The statute does not provide one statewide percentage formula for the support amount. [1]

Oregon Judicial Department guidance likewise explains that spousal support may be transitional, compensatory, or maintenance support and that the court has discretion over whether support is appropriate, the amount, and how long it is paid. [2]

Oregon types of spousal support

Each Oregon support category addresses a different financial situation.

Transitional support can help a spouse obtain education or training needed to reenter or advance in the job market. Compensatory support can apply when one spouse made a significant contribution to the other spouse’s education, training, career, or earning capacity. Maintenance support can provide general financial support for a specified or indefinite period. [1]

ORS 107.105 assigns different factors to those categories. For maintenance support, factors include marriage length, age and health, marital standard of living, relative income and earning capacity, employment skills and experience, financial needs and resources, taxes, and child-related responsibilities.
