How Pennsylvania calculates preliminary spousal support before divorce.

Rule 1910.16-4 uses monthly net income. When dependent children are not part of the action, the preliminary amount is 33% of the payer's available monthly net income minus 40% of the recipient's monthly net income, with a zero floor. [1]

When dependent children are part of the action, Rule 1910.16-4 first uses 25% and 30% to produce a preliminary spousal-support/APL figure, then carries that figure into the child-support calculation. Rule 1910.16-2 also applies special low-income and combined self-support-reserve rules that can eliminate or reduce support. Because this website does not calculate child support, the calculator does not return that intermediate dollar figure. [1][2]

For a spousal-support/APL-only action, Pennsylvania uses a $1,255 monthly self-support reserve. The support amount must be reduced if necessary so the payer retains that reserve. [2]

Final Pennsylvania alimony

Pennsylvania does not use the pre-divorce support formula to set final alimony.

After a divorce decree, 23 Pa.C.S. §3701 allows alimony only if the court finds it necessary. The court considers factors such as earnings and earning capacity, age and health, income sources, marriage length, marital standard of living, education, assets and liabilities, needs, marital misconduct, taxes, property available to meet reasonable needs, and whether the spouse seeking alimony can support themselves through appropriate employment. High-income cases

Pennsylvania still starts with the formula above $30,000 of combined monthly net income.

When combined monthly net income exceeds $30,000, Rule 1910.16-3.1 requires the formula as a preliminary analysis, followed by consideration of deviation factors and additional expenses. For cases without dependent children, this calculator labels that result as preliminary rather than presenting it as the final support order. If dependent children are part of the action, this calculator stops without a dollar result because the required child-support steps are outside its scope. [3]
