Rhode Island alimony amount
Rhode Island courts consider marriage length, income, needs, employability, and other statutory factors when deciding alimony.
Rhode Island General Laws §15-5-16 requires the Family Court to consider marriage length, conduct during the marriage, age and health, occupation, income, vocational skills, employability, liabilities and needs. The court also considers child-custody circumstances, time away from employment for homemaking, education or training needs, marital standard of living, future opportunities to acquire assets and income, and the supporting spouse’s ability to pay. [1]
The statute does not provide one statewide percentage formula for the amount. This worksheet therefore compares a monthly payment selected by the visitor instead of presenting that payment as a Rhode Island court award.
Rhode Island alimony duration
Rhode Island alimony is generally intended to support a spouse while the spouse becomes financially self-sufficient.
Section 15-5-16 describes alimony as support for a reasonable length of time to enable the recipient to become financially independent and self-sufficient. The statute also allows the court to award alimony for an indefinite period when the court finds that appropriate. [1]
Rhode Island does not convert marriage length into one statewide duration table. The statute also states that the alimony obligation automatically terminates when the recipient remarries. [1]
